Mexico's Supreme Court confirmed the law that allows gay couples to adopt children, only in the capital (Mexico City). The gay adoption decision comes a week after the court upheld the constitutionality, from a general point of view, of gay marriage, after it was granted only in Mexico City last year. The justices voted 9-2 against the appeal presented by federal prosecutors and others who had argued the law fails to protect adoptive children against possible ill effects or discrimination, or to guarantee their protection against social stigma for children of same-sex couples and their right to a traditional family; but the Supreme Court said it would be discriminatory to deny gay couples the right to adopt.Given that the Supreme Court had already rejected the argument that same-sex marriage undermines the traditional family unit, the Court found insufficient basis to conclude that same-sex parent adoptions would have an undesirable impact on the so-called traditional family. Moreover, while the right to adopt is confined to Mexico City, the Court also ruled that, under its own version of the Full Faith and Credit Clause, same-sex parents rights as conferred by an adoption in Mexico City need to be honored by all States. The Court's decision goes against the will of Catholic Church, that strongly criticized the Court's judges, arguing that they had been corrupted by the Capital's authorities and some international bodies. The Church's arguments took the Court to the decision to officially dismiss the charges, remarking the necessity of the separation between the Church and the State.
