German Court applies antidiscrimination principle only from 2009
Germany, 28 Sept 2011 – The Administrative Court of Kassel - Hessen [official website] ruled that civil servants living in a German civil partnership (Lebenspartnerschaft) should be equated with spouse for the purpose of pay only from 2009, not from 2003 as requested by the applicant.
In the case K. v. Land Hessen (docket no. 1 A 2381/10) a senior teacher from Frankfurt argued that he should be granted family allowances retroactively from 2003 on the same footing with married civil servants [FAZ and queer.de reports, in German]. The Land of Hessen introduced full equality for civil servants with effect from April 2010, yet Mr K argued that Framewook Directive 2000/78 had to be transposed already 2003. He lodged his request for family allowance in 2008.
The judge found that it was only in 2009 that the German Constitutional Court ruled [1 BvR 1164/07] on the basis of the equality principle enshrined in Article 3 of the Basic Law, the German constitution.
Especially after the judgement by the Court of Justice last May in Römer the decision of the Administrative Court appears doubtful, as EU law prevails. The full judgement was not yet freely available at the time of writing. Appeal was not granted.
The decision comes after the German Parliament has passed some days earlier legislation to place registered and married federal civil servants on the same footing [EJ reports].
